GPS Plot Area Calc (Android app)

1. Agreement

These Terms and Conditions ("Terms") are an agreement between you and Sigma Games ("we", "us", "our"), the developer of the GPS Plot Area Calc Android app (package name com.sigma.gps.plot.calc, "the app").

By installing or using the app you agree to these Terms and to our Privacy Policy. If you do not agree, please do not install or use the app.

2. Who can use the app

The app is intended for adults. If you are under 18, you may use it only with the permission and supervision of a parent or guardian. The app is not directed to children under 13.

You must be allowed to use the app under the laws that apply to you.

3. What the app does, and its limits

------------------------------------

The app lets you measure the area, perimeter and distance of land by walking its boundary with GPS or by tapping points on a map. It lets you save fields, add notes, photos, points and reminders, convert units, see the weather, and import and export files.

Results are approximate. They depend on your phone's GPS signal, the open sky around you, the map imagery, how carefully you walk or tap, and rounding. Phone GPS is usually accurate to a few metres, but can be much worse near buildings, trees, hills or in bad weather.

The app is NOT a legal survey and is NOT a substitute for a licensed surveyor. Do not rely on its results to:

  - set, mark or dispute a legal boundary or property line;

  - buy, sell, lease, mortgage or register land, or fix its price;

  - file a land record, tax return, subsidy, insurance or loan claim;

  - make any decision where an error could cause loss or harm.

For any of these, use a qualified professional and the official records that apply where you live. Local units such as bigha, guntha, kanal and marla differ from region to region, so check the value of the unit you use before relying on a converted result.

Weather information is a forecast from a third party. It can be wrong or out of date. Do not use it for safety-critical decisions.

4. Use the app safely and lawfully

  - Stay aware of your surroundings. Do not look at your phone while driving, riding or crossing a road, and do not walk into traffic, water, steep ground, wildlife, machinery or other hazards while recording a boundary.

  - Only measure and photograph land you are allowed to enter. You are responsible for getting the permission of the landowner or occupier and for following local laws and signs.

  - Do not use the app to harass, track or spy on any person, or to break any law.

5. Your data and content

The fields, measurements, notes, photos, logs and reminders you create belong to you. They are stored on your phone and are not uploaded to us (see the Privacy Policy). Because we do not keep a copy:

  - If you delete a field, clear the app's data, or uninstall the app, that information is gone and we cannot restore it.

  - You are responsible for exporting and keeping your own backups of anything important.

  - Photos saved to your gallery remain there until you delete them.

You are responsible for the files you import, export and share, and for who you share them with. Do not import or share files that you have no right to use.

You give us no licence to your content. We do not receive it, so we do not use it.

6. Permissions

The app asks for access to your location, camera and notifications only for the features described in the Privacy Policy. You can refuse or withdraw any permission in Android settings, but some features will not work without it.

7. Ads, third-party services and data sources

The app is free and is supported by ads. Ads are provided by Google AdMob and may be personalised where you have allowed it. We do not control the content of ads and are not responsible for the products, services or websites they promote.

The app uses third-party services and data. By using the app you also agree to the terms of the services that apply:

  - Google Maps, Places and geocoding: you are bound by the Google Terms of Service (https://policies.google.com/terms), the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps.html) and the Google Privacy Policy (https://policies.google.com/privacy). Maps and places are (c) Google and their licensors.

  - Weather: forecast data comes from MET Norway (Norwegian Meteorological Institute) and is licensed under Creative Commons Attribution 4.0 (CC BY 4.0, https://creativecommons.org/licenses/by/4.0/).

  - Firebase (analytics, crash reports and settings) is provided by Google. See the Privacy Policy.

  - The app also uses open-source software. Its licences are listed in the app under Settings > Data sources & licences.

Third-party services may change, stop working or be unavailable in your area. We are not responsible for them.

8. Acceptable use

You agree not to:

  - copy, modify, sell, rent or distribute the app, or reverse engineer or decompile it, except where the law allows;

  - remove or change any notice of ownership in the app;

  - interfere with the app, the ads, or the services it uses, or try to bypass any limit or protection;

  - use bots, scripts or other automated means to use the app or to generate ad impressions or clicks, or click ads for any reason other than your genuine interest;

  - use the app for any unlawful purpose.

9. Ownership

The app, its design, text, graphics, icons, name and logo belong to Sigma Games or its licensors and are protected by copyright and other laws. We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on your Android devices for your own use, under these Terms. We keep all rights not expressly given to you.

10. Updates and availability

----------------------------

We may update, change or remove features, and we may stop offering the app, at any time. Some updates may be needed for the app to keep working. The app is provided free of charge and we do not promise that it will always be available, error-free or uninterrupted. It needs a GPS signal for many features and an internet connection for maps, search, weather and ads.

11. Disclaimer of warranties

----------------------------

To the fullest extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranty of accuracy, reliability, fitness for a particular purpose, non-infringement or uninterrupted operation. We do not guarantee that results, maps, place information or weather are correct, complete or current.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

12. Limitation of liability

To the fullest extent the law allows, Sigma Games will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, profit, income, land value or opportunity, or for any dispute over land or boundaries, arising from your use of, or inability to use, the app or from your reliance on its results. Our total liability to you for any claim related to the app will not exceed the amount you paid for the app, which is zero because the app is free.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

13. Ending your use

You can stop using the app at any time by uninstalling it. We may suspend or end your right to use the app if you break these Terms. Sections that by their nature should continue (including 3, 5, 9, 11, 12 and 14) will continue after that.

14. Governing law

-----------------

These Terms are governed by the laws of the country where Sigma Games is established, without regard to its conflict of law rules. Any dispute will be handled by the courts of that country, except that if you are a consumer you keep any right you have under the mandatory laws of the place where you live to bring a claim there.

15. Changes to these Terms

--------------------------

We may change these Terms from time to time. The new version will be published at the same web address and the "Last updated" date above will change. If you keep using the app after a change, you accept the updated Terms. If you do not accept them, stop using the app.
